European Legal Commission meets in Luxembourg City

Luxembourg, May 10, 2013. The members of the European Legal Commission (ELC) chaired by its President Aloys Fischer got together on Friday in Luxembourg City for their annual meeting, thereby continuing their work to support the CEV Board of Administration in its decision making.
After the opening by Mr. Fischer, ELC Secretary Rogério Oliveira (POR) summed up the most relevant proposals discussed by the FIVB Legal Commission where he is representing Europe together with two colleagues from the ELC, i.e. Maria Luisa Perez Grasa (ESP) and Domenico D’Alessio (ITA), alongside Hannu Kananen (FIN) and CEV Vice President and Treasurer Philip Berben (BEL).
The ELC members reviewed the latest decisions made by the FIVB Board and FIVB Congress in order to determine their impact and possible implications on the work performed by CEV. The Legal Commission did also assess the regulations currently in place and discussed the concept of unifying their provisions into general Sports Regulations. However, by taking into account the many differences identified among the various competitions, the ELC came to the conclusion that it may be very difficult to draft such general Sports Regulations.
The latest procedures established by the FIVB in order to deal with international transfers and disputes were also discussed by the ELC members. The conclusion of the Commission was to propose to the BOA the establishment of a Tribunal which shall be responsible for studying and eventually settling such disputes.
Concerning the role played by the National Federations in terms of their liability for clubs participating in the European Cups, the Legal Commission will propose to the Board to strengthen the role of the NFs so as to make them responsible for checking the financial situation of their respective clubs before they register for the European Cups competitions.
The various proposals and recommendations prepared by the ELC will be discussed and evaluated in the next meeting of the CEV Board of Administration scheduled for mid June in Turkey.
